Types of Property Records in Stillwater

The Payne County Clerk records all land instruments that affect real estate in Stillwater and the rest of the county. Warranty deeds are the most common type. They transfer ownership and include the seller's guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds, with no warranty attached. Recording Fees for Stillwater Property Records

Recording fees in Oklahoma are set by state law. Under Title 28 Section 32, effective November 1, 2024, the fee for the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that do not meet formatting rules are charged as non-conforming instruments at $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57, also effective November 1, 2024, requires all documents to have a 2-inch top margin and 1-inch margins on all other sides. Documents outside those specs are still recorded but charged the non-conforming rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration under Title 68 Section 3201. On a $200,000 sale, that equals $300 in documentary stamp taxes paid at the time of recording. Photographic copies of recorded documents cost $1.00 per page. Certified copies add another $1.00 per page.

Payne County Assessor and Property Tax

A double homestead exemption applies to households with a gross income of $20,000 or less. Proof of income through W-2 or 1099 forms is required.
