Types of Property Records in Le Flore County

Warranty deeds are the most common document type filed in Le Flore County. They transfer ownership of real estate with the seller's guarantee of clear title. Quitclaim deeds pass whatever interest the grantor holds, with no warranty. Both are recorded when land changes hands. Mortgages and deeds of trust secure loans against property. Releases discharge those liens once the loan is paid. All of these instruments become part of the permanent public record maintained by the County Clerk.

Oil and gas leases are a significant part of the Le Flore County land record index. Southeast Oklahoma has a history of mineral development, and lease filings are common across the county. Mineral deeds transfer subsurface rights separately from surface ownership. This split arrangement is standard practice in Oklahoma and means that a full property search often requires tracing both the surface title and the mineral chain. Tax liens show up in the record when property owners owe back taxes to state or federal agencies. These liens must be cleared before a clean deed can pass at closing.

Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that fail formatting or margin requirements are recorded as non-conforming and charged $25.00 for the first page and $10.00 per additional page.

Senate Bill 57, also in effect from November 1, 2024, requires a 2-inch top margin and 1-inch margins on the remaining sides. Non-conforming documents are still recorded, just at the higher rate. The documentary stamp tax under Title 68 Section 3201 is $0.75 per $500 of consideration. On a $120,000 property sale in Le Flore County, that comes to $180 in stamp taxes paid at the time of recording. Copies of recorded documents cost $1.00 per page, and certified copies add another $1.00 per page.
