Marshall County Overview
Marshall County Clerk and Property Records Office
The Marshall County Clerk is the official custodian of all land records in the county. This office records instruments affecting real estate and indexes them in a permanent public file. The current County Clerk is Gloria Salazar. The office is at the Marshall County Courthouse at 219 Plaza in Madill. The mailing address is P.O. Box 824, Madill, OK 73446. Clerk staff can search by name or legal description and make copies on request. Types of Property Records in Marshall County
The Marshall County Clerk records and indexes a broad range of real estate instruments. Warranty deeds are the standard for property transfers and come with the grantor's guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds, without that guarantee. Mortgages and deeds of trust attach liens to property as security for a loan. Releases discharge those liens once the debt is satisfied. Plat maps for subdivisions and additions are filed here as well.
Oil and gas leases make up a meaningful part of the Marshall County land index. Southern Oklahoma has significant mineral development, and all leases must be filed with the County Clerk to be effective against third parties. Mineral deeds transfer subsurface rights independently of the surface estate. This split ownership arrangement is standard in Oklahoma, and a full title search in Marshall County should cover both surface and mineral records. Tax liens and judgment liens are also indexed at the County Clerk's office when filed against property owners.
The Court Clerk at the same courthouse handles marriage, divorce, and probate records. The Assessor maintains property values and ownership rolls for ad valorem tax purposes. A full property search may require looking at records from all three offices, depending on what you need.
Recording Fees for Marshall County Property Records
Oklahoma sets recording fees statewide under Title 28 Section 32. As of November 1, 2024, the fee for the first page of any instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Non-conforming documents are charged $25.00 for the first page and $10.00 for each additional page.
Senate Bill 57, also effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides. Documents outside those measurements are still accepted and recorded but get charged the non-conforming rate. A documentary stamp tax of $0.75 per $500 of consideration applies under Title 68 Section 3201. On a $120,000 sale, that works out to $180 in stamp taxes at the time of recording. Photographic copies cost $1.00 per page, and certified copies add $1.00 per page on top of that base copy rate.
Marshall County Assessor and Property Tax Records
The Marshall County Assessor is Kyleigh Wescott. The assessor's office is at 100 Plaza, Room 105, in Madill, phone (580) 795-2398. The assessor values all real and personal property in the county for ad valorem tax purposes and maintains assessment rolls listing owner names, parcel descriptions, and valuations. These records complement but are separate from the deed index at the County Clerk's office. When researching a parcel, checking both offices gives a more complete picture of ownership and assessed value.
Property tax collection is handled by County Treasurer Laura Larkin, located at 100 Plaza, Room 104, Madill, phone (580) 795-2463. Tax liens for overdue property taxes are filed with the County Clerk and appear in the searchable land index.
