Johnston County Clerk and Property Records Office

The Johnston County Clerk is Kathy Ross. The clerk is the official custodian of all land records in the county and records instruments affecting real property in the permanent public index. The office is at the Johnston County Courthouse, 403 W. Main, Room 101, in Tishomingo. Hours are 8:30 AM to 4:30 PM Monday through Friday, which is a slightly later start time than many other counties in the state. Call ahead before visiting to confirm hours and fees.

Staff at the clerk's office can search the index by name or legal description and make copies on the spot. Certified copies carry the county seal and are often required for title work, court filings, or legal proceedings. Uncertified copies cost less and are acceptable for general research. The office records a wide range of instruments, from basic warranty deeds to oil and gas lease assignments, mineral conveyances, and judgment liens.

Types of Property Records in Johnston County

Warranty deeds are the most frequently filed instruments in the Johnston County land records index. They transfer ownership of real property and come with the seller's warranty of clear title. Quitclaim deeds pass along whatever interest the grantor holds, with no warranty. Both types are recorded at the County Clerk's office when real estate changes hands. Mortgages and deeds of trust create security liens on property to back loans, and releases clear those liens when the debt is repaid.

Oil and gas leases are a consistent part of Johnston County's recorded instruments. South-central Oklahoma has mineral activity, and these leases are public record once filed. Mineral deeds separate subsurface rights from surface ownership, which is a common arrangement across the state. That split ownership means title work in Johnston County often requires searching both surface deeds and mineral deed chains to get a full picture. Tax liens appear in the index when property taxes are not paid, and federal or state tax liens are also recorded when filed against a property owner.

Plat maps are part of the Johnston County records system. The Court Clerk handles marriage, divorce, and probate records, which are separate from the deed index. The County Assessor keeps property valuation records and parcel data. Each office is a different stop, so knowing what you need ahead of time will save a trip.

Note: Johnston County Court Clerk records, including probate and divorce filings, are separate from the County Clerk's land records and require contacting a different office.

Recording Fees for Johnston County Property Records

Oklahoma sets recording fees statewide through Title 28 Section 32. Effective November 1, 2024, the fee for the first page of any deed, mortgage, or recorded instrument is $8.00. Each additional page costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Non-conforming documents, meaning those that do not meet margin and formatting requirements, are charged $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57, effective the same date, requires a 2-inch top margin and 1-inch margins on the remaining three sides. Documents outside those specs are still accepted but charged at the non-conforming rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration at the time of recording, under Title 68 Section 3201. On a $120,000 sale, that equals $180 in stamp taxes. Photographic copies of recorded documents cost $1.00 per page, and certified copies add $1.00 per page on top of that.
