Coal County Clerk and Property Records Office

The Coal County Clerk is the official custodian of all land records in the county. The office records instruments affecting real estate and stores them in a permanent public index. The current County Clerk is Eugina Loudermilk. The office is at the Coal County Courthouse, 1 N. Main Street in Coalgate. Office hours are 8:00 AM to 4:00 PM, Monday through Friday. Note that Coal County closes an hour earlier than many other county offices, so plan your visit accordingly.

The clerk's office handles all recorded instruments, from basic warranty deeds to oil and gas lease assignments and federal judgment liens. Staff can search by name or legal description and can make copies while you wait. Certified copies carry the county seal and are typically required for title work or legal proceedings. Plain copies are cheaper and work fine for research. Revenue from copy services at the courthouse goes to support Coal County operations.

Types of Property Records in Coal County

The Coal County Clerk records and maintains a range of instruments that affect real estate. Warranty deeds are the most frequently filed type. They transfer ownership with the seller's promise of clear title. Quitclaim deeds transfer whatever interest the grantor holds, with no title warranty. Mortgages and deeds of trust create liens on property to secure loans, while releases clear those liens when the debt is settled. All of these go into the permanent county index.

Oil and gas leases are an important part of the Coal County records system. The county's geology includes areas with mineral development activity, and these leases are public record once filed. Mineral deeds, which transfer subsurface rights separately from surface ownership, also show up regularly in the index. This split ownership pattern is common throughout Oklahoma and makes mineral deed research a key part of any complete title search in Coal County.

Tax liens filed for unpaid property taxes and federal or state judgment liens also appear in the land records index. Plat maps and subdivision filings are part of the clerk's records as well. Military discharge papers (DD-214 forms) are recorded at the county level and held at the courthouse. Court case records, including marriage, divorce, and probate documents, are held separately by the Coal County Court Clerk, not by the property records office.

Note: Coal County land records go back further through scanned images (1982) than through the searchable index (1999), so older documents may require manual searching at the courthouse.

Coal County Recording Fees

Oklahoma sets recording fees by state law. Under Title 28 Section 32, updated effective November 1, 2024, the fee for the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that don't meet formatting requirements are treated as non-conforming and charged $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57, effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides for documents recorded with Oklahoma county clerks. Documents outside those specs are still accepted but at the higher non-conforming rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration under Title 68 Section 3201 at the time of recording. Copies of recorded documents are $1.00 per page, with certified copies adding $1.00 per page on top of the base fee.
