Hughes County Clerk and Property Records Office

The Hughes County Clerk is the official keeper of all land records in the county. This office records instruments that affect real property and holds them in a permanent public index. The current County Clerk is Angela Brooks. The office is at the Hughes County Courthouse at 200 N. Broadway in Holdenville. Call ahead to confirm hours and copy fees before you visit, since both can change without notice.

Staff at the clerk's office can search by name or by legal description and can make copies while you wait. Certified copies carry the county seal and are often needed for title work or legal proceedings. Uncertified copies cost less and work fine for general research. The office handles everything from simple warranty deeds to oil and gas lease assignments and federal tax liens.

Types of Hughes County Property Records

The Hughes County Clerk records a wide range of documents that affect real property. Warranty deeds are the most common. They transfer ownership and come with the seller's guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds but carry no warranty. Both types go into the permanent index when property changes hands. Mortgages and deeds of trust create liens on property to secure loans. Releases discharge those liens once debts are paid off.

Oil and gas leases make up a significant portion of the Hughes County records index. This part of south-central Oklahoma has long had active mineral development. Leases are public record once filed with the clerk. Mineral deeds transfer subsurface rights separately from the surface, and this split-ownership arrangement is common across Oklahoma. If you are doing title work in Hughes County, mineral deed searches are a necessary step. Tax liens appear in the index when property taxes go unpaid. Federal and state liens also show up when recorded against a property owner.

The County Clerk's records are separate from those held by the Court Clerk, which include marriage, divorce, and probate documents. The County Assessor keeps valuation records and parcel data. Each office maintains its own index, so a full property search may involve more than one stop.

Recording Fees for Hughes County Property Records

Oklahoma sets recording fees by state law under Title 28 Section 32. Effective November 1, 2024, the fee for the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that don't meet formatting requirements are charged as non-conforming instruments at $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57, also effective November 1, 2024, requires all documents to have a 2-inch top margin and 1-inch margins on all other sides. Documents that fall outside those specs can still be recorded but are charged the non-conforming rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration under Title 68 Section 3201. On a $200,000 sale, that works out to $300 in stamp taxes paid at recording. Photographic copies of recorded documents cost $1.00 per page, and certified copies add another $1.00 per page.

Note: Fees listed here reflect state law as of November 2024. Always confirm current fees with the Hughes County Clerk before submitting documents for recording.

The assessor values all real and personal property in the county for tax purposes and keeps assessment rolls listing owners, parcel descriptions, and valuations. These records are separate from the deed index but are useful for identifying current ownership and parcel boundaries.

The County Treasurer handles property tax collection and maintains payment history. The treasurer is Dawn Lindsey and can be reached at (405) 379-5487. Tax rolls are separate from deed records but are an important part of a full property search. When property taxes go unpaid, liens are filed with the County Clerk and show up in the land records index. For current tax status and payment history, contact the treasurer's office directly. Statewide tax roll data is also searchable through OKTaxRolls.com.
