Types of Property Records in McIntosh County

The McIntosh County Clerk records all instruments that affect real estate within the county. Warranty deeds are the standard document when land is sold with a guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds without any warranty, and they are common in estates, divorces, and family transfers. Mortgages and deeds of trust create security interests in land, while releases clear those interests once the underlying debt is paid. All of these go into the permanent land records index when filed.

Oil and gas activity is part of McIntosh County's land record history. Mineral rights can be split from surface ownership, and when that happens, mineral deeds transfer the subsurface rights as a separate interest. Oil and gas leases are recorded as public documents and indexed alongside surface deeds. Assignments, extensions, and terminations of leases also show up in the index. Searching both surface and mineral chains is standard practice for a complete title review in eastern Oklahoma counties like McIntosh.

Tax liens for unpaid property taxes appear in the clerk's land records. Federal tax liens and state judgment liens are also filed here when they are entered against a property owner. Plat maps are part of the system and help interpret the legal descriptions on deeds. Military discharge papers (DD-214) are filed with the County Clerk as well. Court Clerk records, including probate, marriage, and divorce documents, are maintained in a separate system and require a separate search.

Note: For McIntosh County probate and marriage records, contact the Court Clerk's office, which is separate from the County Clerk that handles land records.

Recording Fees for McIntosh County Property Records

Oklahoma sets recording fees by statute. Under Title 28 Section 32, effective November 1, 2024, the fee for the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page of the same document is $2.00. Every instrument also carries a $10.00 records management and preservation fee. Documents that fail to meet formatting standards are non-conforming and are charged $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57 sets the margin requirements for all documents recorded on or after November 1, 2024: a 2-inch top margin and 1-inch margins on all other sides. Documents outside these specs are still accepted but charged at the non-conforming rate. Oklahoma also collects a documentary stamp tax under Title 68 Section 3201 at $0.75 per $500 of consideration. On a $150,000 sale, that is $225 in stamp taxes due at the time of recording. Photographic copies of filed documents cost $1.00 per page, and certified copies add another $1.00 per page to that base rate.
