Types of Property Records in Muskogee County

Warranty deeds are filed with the Muskogee County Clerk whenever real estate changes hands with a title guarantee from the seller. Quitclaim deeds transfer whatever interest the grantor holds, with no warranty. Mortgages and deeds of trust create liens against property to secure financing. Once a loan is paid off, a release of mortgage is recorded to clear the lien from the title. All of these transactions become part of the Muskogee County land records index and are searchable online through the OKCountyRecords portal.

Oil and gas leases are a meaningful part of the Muskogee County record index. Eastern Oklahoma has a long history of mineral development, and leases are public record once filed with the clerk. Mineral deeds are also common in this region. They transfer subsurface rights separately from surface ownership, which is a standard arrangement across Oklahoma. Anyone doing title work in Muskogee County needs to search both surface and mineral records. Tax liens for unpaid property taxes are also recorded here, along with state, federal, and judgment liens that attach to property in a debtor's name.

Plat maps, subdivision documents, and military discharge papers (DD-214) are also part of the County Clerk's records system. The Muskogee County Court Clerk holds separate files for marriage, divorce, and probate from 1907. The County Assessor maintains valuation data and tax rolls for the county.

Recording Fees for Muskogee County Property Records

Recording fees in Oklahoma are governed by state law. Under Title 28 Section 32, updated effective November 1, 2024, the fee for the first page of any recorded instrument is $8.00. Each additional page of the same document is $2.00. A records management and preservation fee of $10.00 is charged per instrument. Documents that do not meet formatting requirements are classified as non-conforming and charged $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57, effective the same date, requires all documents to have a 2-inch margin at the top and 1-inch margins on all other sides. Documents outside those specs will still be recorded but at the non-conforming rate. Oklahoma collects a documentary stamp tax of $0.75 per $500 of stated consideration under Title 68 Section 3201. On a $180,000 home sale, that comes to $270 in documentary stamp taxes due at the time of recording. Photographic copies are $1.00 per page, and certified copies add another $1.00 per page on top of that.
