Types of Property Records in Adair County

Land records filed with the Adair County Clerk cover a wide range of transactions. Warranty deeds are the most common type. They transfer ownership and come with the seller's guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds, with no warranty. Both types are recorded when property changes hands. Mortgages and deeds of trust create liens on property to secure loans. Releases discharge those liens once the debt is paid. All of these documents go into the permanent county record.

Oil and gas leases are a significant part of the Adair County record index. Eastern Oklahoma has active mineral development, and these leases are public record once filed. Mineral deeds transfer subsurface rights separately from surface land. This split ownership arrangement is common in Oklahoma and makes mineral deed searches an important part of title work. Tax liens appear in the index when property taxes go unpaid. Federal and state liens show up when taxes or judgments are recorded against a property owner.

Plat maps and military discharge papers (DD-214 forms) are also part of the Adair County records system. The Court Clerk maintains separate records including marriage, divorce, and probate documents from 1907. The County Assessor holds land records and property valuation data.

Note: The Adair County Court Clerk can be reached at (918) 696-7633 for marriage, divorce, and probate records, which are separate from land records at the County Clerk's office.

Recording Fees for Adair County Property Records

Recording fees in Oklahoma are set by state law. Under Title 28 Section 32, updated effective November 1, 2024, the fee for the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that do not meet formatting requirements are charged as non-conforming instruments at $25.00 for the first page and $10.00 for each additional page.

Senate Bill 57, also effective November 1, 2024, requires all documents to have a 2-inch top margin and 1-inch margins on all other sides. Documents outside those specs are still recorded but charged the non-conforming rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration under Title 68 Section 3201. On a $150,000 sale, that equals $225 in documentary stamp taxes paid at the time of recording. Photographic copies of recorded documents cost $1.00 per page, and certified copies add another $1.00 per page.
