Types of Property Records Filed in Delaware County
Delaware County's land records index holds a wide range of recorded instruments. Warranty deeds are the most common type. They transfer real estate ownership and come with the seller's guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds, with no warranty. Both types go into the permanent county record every time property changes hands. Mortgages and deeds of trust create liens against property to secure loans. Once a loan is repaid, a release is recorded to remove the lien from the title chain.
Oil and gas leases are part of the Delaware County record system. The county has mineral development activity, and these leases are public record from the date of filing. Mineral deeds transfer subsurface rights separately from surface ownership, a common arrangement in Oklahoma. Tax liens appear in the index when property taxes fall delinquent. Delaware County Recording Fees
Oklahoma sets recording fees by state law. Under Title 28 Section 32, effective November 1, 2024, the fee for the first page of any deed, mortgage, or recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that do not meet margin requirements are recorded as non-conforming at $25.00 for the first page and $10.00 per additional page.
Senate Bill 57, also effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides. Documents outside those specs are still accepted but at the higher non-conforming rate. Oklahoma's documentary stamp tax under Title 68 Section 3201 is $0.75 per $500 of consideration. On a $200,000 sale, that equals $300 in stamp taxes due at the time of recording. Plain copies of recorded documents are $1.00 per page. Certified copies add another $1.00 per page.
