Types of Property Records in Pawnee County

Land records filed with the Pawnee County Clerk cover a range of instruments. Warranty deeds are the most common. They transfer ownership with the seller's guarantee of clear title. Quitclaim deeds convey whatever interest the grantor holds, with no warranty. Mortgages and deeds of trust create liens to secure loans, and releases clear those liens once the debt is satisfied. All of these go into the permanent county index.

Oil and gas leases and mineral deeds are a regular part of the Pawnee County record system. North central Oklahoma has active mineral development, and these instruments are public record once filed. Mineral deeds can transfer subsurface rights separately from surface ownership. This split arrangement is common in Oklahoma. Tax liens appear in the index when property taxes go unpaid. Federal and state liens recorded against an owner also show up in county records and must be cleared before a clean title transfer can occur.

Plat maps and DD-214 military discharge papers are also maintained by the clerk. Marriage, divorce, and probate records are held separately by the Court Clerk. Property valuation and assessment data is with the County Assessor.

Pawnee County Recording Fees

Recording fees in Oklahoma are set by state law under Title 28 Section 32, with updates taking effect November 1, 2024. The first page of any deed, mortgage, or other instrument costs $8.00 to record. Each additional page of the same document is $2.00. A records management and preservation fee of $10.00 per instrument also applies. Documents that fail to meet formatting requirements are charged as non-conforming at $25.00 for the first page and $10.00 per additional page.

Senate Bill 57, also effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides. Documents that fall outside those specs are recorded but at the higher non-conforming rate. The state's documentary stamp tax under Title 68 Section 3201 is $0.75 per $500 of consideration. A $175,000 sale carries $262.50 in documentary stamp taxes at recording. Copies of recorded instruments cost $1.00 per page. Certified copies add another $1.00 per page.
