Types of Property Records in Texas County

Warranty deeds are the most frequently recorded instrument in Texas County. They transfer real property ownership and carry the seller's guarantee of clear title. Quitclaim deeds convey whatever interest the grantor holds, with no warranty. Both show up in large numbers in any year's filing activity. Mortgages create liens on property to secure a loan. Releases discharge those liens when the debt is satisfied. These are routine recordings that move through the county clerk's office constantly.

Oil and gas leases are a significant part of the Texas County record index. The Oklahoma Panhandle has active energy development, and lease filings are common. Mineral deeds transfer subsurface rights independently of surface ownership. That split ownership structure is widespread across Oklahoma and means a full title search often involves looking at both surface deeds and mineral records. Tax liens appear in the land records index when property taxes go unpaid, and federal or state liens against property owners are also recorded with the County Clerk.

Plat maps and survey documents are part of the county records system. They show how land has been divided and are a key reference for legal descriptions. Agriculture is the dominant land use in Texas County, so farm deeds and irrigation water rights documents are also commonly recorded. For marriage, divorce, and probate records, contact the Texas County Court Clerk, which is a separate office from the County Clerk.

Recording Fees for Texas County Instruments

Oklahoma sets recording fees by state statute. Under Title 28 Section 32, updated effective November 1, 2024, the fee for the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that do not conform to the margin requirements under Senate Bill 57 are recorded as non-conforming instruments at $25.00 for the first page and $10.00 per additional page.

SB57 requires a 2-inch top margin and 1-inch margins on all other sides for documents recorded on or after November 1, 2024. The documentary stamp tax under Title 68 Section 3201 is $0.75 per $500 of consideration and is paid at the time of recording. On a $150,000 sale, that comes to $225 in stamp taxes. Photographic copies cost $1.00 per page. Certified copies add another $1.00 per page on top of the copy fee.
