Types of Property Records Held in Custer County
The Custer County Clerk's land records index covers a broad range of instruments. Warranty deeds are the most common type. They transfer property ownership and include the seller's guarantee that the title is clear. Quitclaim deeds transfer whatever interest the grantor holds, with no warranty. Mortgages and deeds of trust place a lien on real property to secure a loan. Releases clear those liens once the debt is satisfied. All of these go into the permanent public record.
Oil and gas leases are a significant part of the Custer County record system. Western Oklahoma has active energy development, and leases are on file from the moment they are recorded. Mineral deeds transfer subsurface rights independently of the surface land, which is a common split-ownership situation in this part of the state. Tax liens appear when property taxes go delinquent. Federal and state liens may also be recorded against landowners.
Plat maps and military discharge papers (DD-214 forms) are also part of the Custer County records system. The Custer County Court Clerk, located at 603 B St in Arapaho and reachable at (580) 323-3233, holds separate records for marriage, divorce, and probate matters. The County Assessor maintains property valuation and assessment rolls under a different system.
Recording Fees in Custer County
Oklahoma recording fees are set by state law and apply to all counties. Under Title 28 Section 32, effective November 1, 2024, the first page of any deed, mortgage, or other recorded instrument is $8.00. Each additional page is $2.00. A records management and preservation fee of $10.00 is added per instrument. Non-conforming documents, those that fail to meet margin requirements, are charged $25.00 for the first page and $10.00 per additional page.
Senate Bill 57, also effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides for any document submitted for recording in Oklahoma. Documents outside those specs are still recorded but at the non-conforming rate. The documentary stamp tax under Title 68 Section 3201 is $0.75 per $500 of consideration. On a $100,000 sale, that comes to $150 in stamp taxes. Regular copies of recorded documents are $1.00 per page. Certified copies cost an additional $1.00 per page. Plat copies are $10.00 for one block and $25.00 for two or more blocks.
