Types of Property Records in Rogers County

The Rogers County Clerk indexes and stores a wide range of instruments affecting real estate. Warranty deeds are the most common type filed. They transfer ownership and carry the seller's guarantee that title is clear. Quitclaim deeds pass along whatever interest the grantor holds without any warranty. Both types go into the permanent index. Mortgages and deeds of trust are recorded to create liens on property when a loan is secured. Releases discharge those liens once the debt is paid off.

Oil and gas leases are a significant category of Rogers County property records. The county sits in an area with active mineral development, and all leases must be recorded to be effective against third parties. Recording Fees for Rogers County Property Records

Oklahoma sets recording fees by state law. Under Title 28 Section 32, effective November 1, 2024, the fee to record the first page of any deed, mortgage, or other land instrument is $8.00. Each extra page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Documents that do not meet the margin requirements are charged the non-conforming rate of $25.00 for the first page and $10.00 for each page after that.

Senate Bill 57, also effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides. Non-conforming documents are still accepted but cost more to record. Oklahoma also collects a documentary stamp tax under Title 68 Section 3201. The rate is $0.75 per $500 of stated consideration. On a $200,000 sale in Rogers County, the documentary stamp tax would be $300. Photographic copies cost $1.00 per page, and certified copies add $1.00 per page on top of that. Pay fees at the time of recording. The clerk's office does not accept partial payment.
