The office fax is 580-357-9478 and the email is countyclerk@comanchecounty.us. Hours are Monday through Friday, 8:00 AM to 5:00 PM. The County Clerk handles and maintains all county records other than court and marriage records, which fall under the Court Clerk. State statutes give the County Clerk dual roles: registrar of deeds and secretary to the Board of County Commissioners. As registrar of deeds, the office receives all instruments that affect real property, enters them into the public index, and stores the originals. As secretary to the commissioners, the clerk files meeting agendas and minutes. These are two separate functions but both are handled through the same office in Suite 304.

Types of Property Records in Comanche County

The Comanche County Clerk records all instruments affecting real property in the county. Warranty deeds are the most common filing. They transfer ownership with the seller's guarantee of clear title. Quitclaim deeds pass along whatever interest the grantor holds, without any title warranty. Both types are entered into the public index when real estate changes hands. Mortgages and deeds of trust create security interests in land to secure loans. Releases cancel those interests once the debt is paid.

Oil and gas leases are part of the Comanche County records. The county has mineral activity and these leases go on public record when filed. Mineral deeds, which transfer subsurface rights separately from surface land, also appear in the index regularly. The County Assessor tracks both real property (land and buildings) and personal property (furniture, fixtures, equipment, inventory for businesses, farm equipment, and manufactured homes). Manufactured housing records are maintained separately from standard real estate deeds but are part of the assessor's database.

Tax liens from unpaid property taxes and state or federal judgment liens also appear in the land records index. These are important to check during any title search. Plat maps, subdivision filings, and DD-214 military discharge papers round out the records held at the clerk's office. Court case records, including marriage records, are handled by the Comanche County Court Clerk at (580) 355-4017, not by the County Clerk's office.

Note: Personal property records in Comanche County include farm equipment and manufactured homes, which are valued annually by the assessor and taxed separately from real estate.

Comanche County Recording Fees

Comanche County uses a county-specific fee schedule that differs from the standard Oklahoma rate. Recording the first page of a deed, mortgage, or other instrument costs $18.00 in Comanche County. Each additional page is $2.00. The preservation fee per instrument is $5.00 in Comanche County, compared to the statewide standard of $10.00. These differences are worth noting if you are used to filing in other Oklahoma counties.

Senate Bill 57, effective November 1, 2024, requires all recorded documents to have a 2-inch top margin and 1-inch margins on all other sides. Documents that don't meet these specs are classified as non-conforming and charged at a higher rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration under Title 68 Section 3201, which applies at the time of recording regardless of county. On a $200,000 sale in Lawton, that equals $300 in stamp taxes due at recording. Copies of recorded documents cost $1.00 per page. Certified copies add another $1.00 per page on top of the base rate.
