Types of Property Records in Jackson County

Warranty deeds are the most common document in the Jackson County land records index. They transfer ownership and include the seller's guarantee of clear title. Quitclaim deeds transfer whatever interest the grantor holds, with no warranty attached. Mortgages and deeds of trust create liens on property to secure loans. Once a loan is repaid, a release is filed to clear that lien from the record. All of these instruments are part of the permanent Jackson County index.

Oil and gas leases are recorded regularly in Jackson County. Southwestern Oklahoma has significant mineral activity, and these leases are public record once filed. Mineral deeds transfer subsurface rights separately from surface ownership. That split-ownership arrangement means mineral deed searches are often a required step in title work. Tax liens appear when property taxes are not paid, and federal or state agency liens are also recorded when filed against a property owner.

Plat maps for subdivisions and additions are part of the Jackson County records system. The Court Clerk holds separate records, including marriage licenses, divorce decrees, and probate documents. Always clarify which office you need before visiting the courthouse.

Note: The Jackson County Assessor's website offers interactive property mapping and a free real property search separate from the deed index maintained by the County Clerk.

Recording Fees for Jackson County Property Records

Oklahoma recording fees are set by state law. Under Title 28 Section 32, updated effective November 1, 2024, the fee for the first page of any deed, mortgage, or recorded instrument is $8.00. Each additional page of the same document costs $2.00. A records management and preservation fee of $10.00 applies per instrument. Non-conforming documents are charged at $25.00 for the first page and $10.00 per additional page.

Senate Bill 57, effective November 1, 2024, requires a 2-inch top margin and 1-inch margins on all other sides. Documents outside those specs are still accepted but charged the non-conforming rate. Oklahoma also collects a documentary stamp tax of $0.75 per $500 of consideration under Title 68 Section 3201. On a $175,000 sale, that equals $262.50 in stamp taxes paid at the time of recording. Copies of recorded documents cost $1.00 per page. Certified copies add $1.00 per page on top of that.
